Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of Dermio, operated by AURA MANAGEMENT LLC ("Dermio", "we", "us", or "our"), including our mobile application, related websites, APIs, content, subscriptions, and support services (collectively, the "Service").

By downloading, accessing, creating an account for, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you use the Service on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms, and "you" means both you and that entity.

Eligibility

You must be at least 13 years old, or the minimum age required in your country or state to validly use the Service, whichever is higher. If you are under the age of majority where you live, you may use the Service only with permission and supervision from your parent or legal guardian.

The Service is not intended for children under 13.

Dermio helps users scan and understand skincare, cosmetic, haircare, and related personal-care products. The Service may include:

Accounts and Security

Account Creation

Some features require an account. You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for all activity that occurs under your account, for maintaining the confidentiality of your login credentials, and for promptly notifying us of any unauthorized access, suspected compromise, or misuse.

We may refuse registration, reclaim usernames, or suspend or terminate accounts if reasonably necessary to protect the Service, our users, our partners, or third parties.

Device-Level and Anonymous Access

Some features may operate without a traditional account by using a device-level, anonymous, or pseudonymous identifier. Access to purchases, scan history, or features linked to such identifiers may be limited if you delete the app, clear device data, change platforms, or fail to use available restore or account-linking features.

Paid Subscriptions, Billing, Cancellation, and Refunds

Subscriptions and Auto-Renewal

If the Service offers subscriptions, trials, premium access, or paid digital content, pricing, billing interval, included features, and renewal terms will be shown at or before checkout.

Unless otherwise stated at checkout and except where prohibited by law, subscriptions automatically renew for the same billing period until cancelled.

You authorize us and/or our payment processor, app store, or subscription infrastructure provider to charge the applicable fees, taxes, and renewals to your selected payment method.

Store Billing

Purchases may be processed through the Apple App Store, Google Play, web billing, or another billing provider identified at checkout. Where a purchase is made through a third-party app store or billing platform, that platform's additional terms, billing rules, refund rules, and technical constraints may apply in addition to these Terms.

Price Changes

We may change pricing for future billing periods where allowed by law. Where required, we will provide notice before a new price takes effect.

Free Trials and Promotional Offers

If a free trial or promotional price is offered, it will convert into a paid subscription unless you cancel before the stated deadline, unless applicable law requires a different approach.

Cancellation

You may cancel at any time using your App Store or Google Play subscription settings, the billing portal or account settings we provide, or any other cancellation route identified at checkout.

Cancellation stops future renewals but does not normally retroactively refund amounts already paid, except where required by law or where a refund is granted under the applicable billing platform's rules.

Refunds

Refund eligibility depends on where and how the purchase was made, local law, and any mandatory consumer rights that apply.

Nothing in these Terms limits any mandatory statutory right you may have to a refund, cancellation, or remedy.

Restore Purchases

If your purchase was made through a store account that supports restoration, you may be able to restore access using the Service's "Restore Purchases" function or an equivalent workflow. Restoration may fail if store rules, device state, account-linking choices, or platform limitations prevent it.

Dermio is a general skincare information tool. It does not provide medical advice, dermatology advice, diagnosis, treatment, prescription guidance, or emergency care.

Product scores, ingredient flags, UV guidance, pregnancy cautions, and AI-generated text are for educational purposes only. Individual reactions vary. Always read product packaging, allergen warnings, and manufacturer instructions, patch-test new products, and consult a qualified healthcare professional for medical concerns, pregnancy, nursing, allergies, rashes, or medication interactions.

Do not use the Service as a substitute for professional judgment in urgent or high-risk situations. If you think you may have a medical emergency, contact emergency services or a qualified clinician immediately.

AI Features and Product Analysis

AI Providers

Some features may use AI service providers to process text, images, structured prompts, product data, barcodes, ingredient lists, skin profile details, and related metadata in order to generate, classify, summarize, transform, moderate, or analyze content.

No Guarantee of Accuracy or Suitability

AI-generated output and product analysis may be incomplete, inaccurate, outdated, offensive, biased, or unsuitable for your purpose. Output may also be similar or identical to material generated for other users or third parties.

Dermio provides general informational guidance only. It is not medical advice, dermatology advice, diagnosis, treatment, or a substitute for a qualified professional. Always review product labels, manufacturer instructions, allergen warnings, and professional guidance before relying on the Service.

You must evaluate all AI output before relying on it, sharing it, publishing it, or using it in any consequential context.

Your Responsibility for Inputs

You represent and warrant that you have all rights, permissions, licenses, and legal bases needed to submit any prompt, file, message, image, product photo, barcode, ingredient label, or other input to the Service and to authorize us and our processors to handle it.

You must not submit sensitive personal data, regulated data, confidential information, trade secrets, children's data, or third-party material unless you have clearly assessed that submission is lawful and appropriate for your use case.

Safety Controls

We may apply moderation, filtering, human review, throttling, usage limits, or feature restrictions to AI requests or outputs. We may refuse to process content that is unsafe, unlawful, or inconsistent with our policies or provider rules.

Third-Party Product Data and Search Sources

Some product, ingredient, barcode, safety, cosmetic, UV, or related information shown in the Service may come from third-party data sources, search providers, manufacturer materials, community-contributed sources, public web sources, or other external providers.

That data may be incomplete, inaccurate, out of date, unavailable, or inconsistent with the physical product in your possession. It is provided for general informational purposes only unless we expressly state otherwise.

Where required by applicable source licenses or provider terms, we may provide attribution, source links, and licensing notices in the app, on our website, or in supporting documentation.

User-Generated Content

Your Content

You may submit prompts, messages, photos, scans, product information, ingredient labels, support requests, profile content, reviews, comments, and other material through the Service ("User Content").

You retain any rights you hold in your User Content, subject to the rights you grant below.

License to Us

To operate, improve, secure, and provide the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, adapt, transmit, display, and otherwise use your User Content solely as needed to:

We may remove, refuse, restrict, or moderate User Content at our discretion where we reasonably believe it violates these Terms, provider rules, law, or third-party rights.

Intellectual Property

We and our licensors own the Service, including our software, branding, user interface, compilations, and all related intellectual property rights, except for third-party materials and your User Content.

These Terms give you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose, subject to these Terms.

Except as expressly allowed by applicable law or by us in writing, you may not copy, republish, sell, rent, decompile, reverse engineer, distribute, or create derivative works from the Service.

Third-Party Licenses and Attribution

Certain data, images, SDKs, APIs, or open-source components used by the Service may be subject to third-party licenses, attribution conditions, or source-specific restrictions. Where required, those notices form part of your use of the Service.

Copyright Complaints and Takedowns

These Terms are governed by the applicable laws of the United States, excluding conflict-of-laws rules.

Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in a court located in the United States that has jurisdiction over the dispute, unless mandatory law requires a different forum.

Nothing in this section limits any non-waivable consumer rights or statutory remedies.

Changes to These Terms

We may update these Terms from time to time. If we make a material change, we may notify you by posting the updated Terms in the app, on our website, by email, or by another reasonable method.

The updated Terms take effect on the stated effective date. If you continue to use the Service after that date, you agree to the updated Terms, except where applicable law requires a different form of acceptance.
